EDGARD — Errol and Tonya Victor, the married couple found guilty this month in the homicide of Tonya’s 8-year-old son M.L. Lloyd III, have filed a motion to delay the imposition of their sentences.

The St. John the Baptist Parish Clerk of Court’s Office said the Victors filed the motion last week and Judge Mary Becnel will decide on the matter Monday.

On Aug. 1, Errol was found guilty of second-degree murder, and Tonya was found guilty of manslaughter in the April 2008 homicide of M.L.

Becnel set an Aug. 16 deadline for any post-trial motions, which would have included the Victors’ possible motion for a new trial.

District Attorney Tom Daley said Errol’s sentence for second-degree murder is non-discretionary life without the possibility of parole. He said after formal sentencing Errol would be remanded to the custody of the Department of Corrections, where he would more than likely be sentenced to Angola.

Tonya, on the other hand, will be sentenced to anywhere from 10 to 40 years for her manslaughter charge.

Daley said while everyone is credited for time served, Tonya would not be allowed to use some of the time she’s spent in jail to ease her sentence because some of that time was sentenced for other charges, included jumping bail.

The Victors remain in the custody of the St. John Parish Sheriff’s Office.
